Purchase Terms and Conditions
These Purchase Terms and Conditions (“Terms”) apply to all purchases made from Nikki Malvar Studio (“we”, “us”, “our”) via Nikki Malvar Studio (the “Website”). By placing an order, you agree to be bound by these Terms.
Choosing Art
Please choose carefully before placing an order. All artworks are produced to order and, as such, we do not offer refunds or exchanges for change of mind or incorrect selection.
Nothing in these Terms limits your rights under Australian Consumer Law. Where a product is faulty, damaged, or not as described, you may be entitled to a remedy in accordance with Australian Consumer Law.
Nikki Malvar Studio is not responsible for damage caused by misuse, mishandling, or failure to exercise reasonable care after delivery.
Prices
All transactions are processed in Australian Dollars (AUD) and include a Goods and Services Tax (GST) of 10% unless otherwise stated.
All prices displayed on the Website are subject to change without notice. This includes price adjustments as limited edition works progress toward sell-out, as well as promotional, discounted, or increased pricing applied from time to time. The applicable price is the price displayed on the Website at the time an order is placed and payment is completed.
Prices listed on the Website may differ from prices published elsewhere, including on third-party platforms or in prior communications.
In the event that a product is listed at an incorrect price or with incorrect information due to a typographical or system error, Nikki Malvar Studio reserves the right to cancel or refuse any order placed for that product. If payment has already been processed, a full refund will be issued.
Wholesale, trade, or project-based pricing may be offered at our discretion and will be confirmed in writing (email is sufficient). Such pricing applies only to the specific agreement confirmed.
Product Appearance
We make every effort to display products as accurately as possible on the Website. Images are provided for illustrative purposes only and may include styled or digital interior mockups to help visualise scale, placement, and context. These images do not represent installed artworks in lived spaces.
Due to variations in screen calibration, lighting conditions, and display settings, colours may appear differently on different devices. We cannot guarantee that colours displayed on your screen will exactly match the final printed artwork.
All artworks are produced to order using fine art printing processes. Variations in paper stock, surface texture, and natural material characteristics may occur and are inherent to the medium. These variations form part of the unique character of each work, and no two artworks will be identical.
Nothing in this section is intended to limit or exclude your rights under Australian Consumer Law.
Framing
Where framing is offered, it is provided via affiliated third-party suppliers. We take care to work with professional partners and to coordinate framing to a high standard; however, framing services are fulfilled by third parties and Nikki Malvar Studio is not responsible for delays, defects, or issues arising from third-party framing services, except where required under Australian Consumer Law.
Orders
Receipt of an order confirmation does not constitute acceptance of your order. Nikki Malvar Studio reserves the right to accept, decline, or limit an order for any reason, including availability, production constraints, or errors in product information. If an order is declined or limited, any payment received will be refunded accordingly.
Requests for changes or cancellations must be submitted in writing to studio@nikkimalvar.com as soon as possible. Changes or cancellations cannot be guaranteed once production has commenced and are subject to our discretion. Approved changes or cancellations may incur additional costs.
By placing an order, you confirm that:
you are at least 18 years of age;
all information provided is accurate and complete;
you are authorised to use the payment method provided; and
sufficient funds are available to cover the cost of the order.
A confirmation email will be sent acknowledging receipt of your order. Once your order has been fulfilled, a separate dispatch confirmation will be provided.
Payment
Payment must be made in full at the time of purchase.
Payments are processed securely via third-party providers including Squarespace, Stripe, and PayPal. Nikki Malvar Studio does not store full payment details. Any issues relating to payment processing should first be directed to the relevant payment provider. Where required under Australian Consumer Law, we will assist in resolving payment-related issues.
Shipping
All artworks are produced to order. Estimated production timeframes are provided on the Website and generally fall within approximately 12 business days, however timeframes may vary depending on the artwork, framing, and production requirements.
Shipping is managed by third-party logistics providers. While we take care to coordinate delivery, we cannot guarantee delivery dates. If your order does not arrive within a reasonable timeframe, please contact us.
To the extent permitted by law, Nikki Malvar Studio is not liable for delays caused by third-party logistics providers or circumstances beyond our control. If delivery access may be difficult, please notify us at the time of ordering.
At launch, shipping is available within Australia only.
Refunds and Exchanges
We comply with Australian Consumer Law.
If your artwork arrives damaged or faulty, please notify us in writing within a reasonable timeframe after delivery, including photographs of the issue. We may require the artwork to be returned for assessment before a remedy is provided.
Where a product has a major fault, you may be entitled to a refund, replacement, or other remedy as required by Australian Consumer Law. Where a fault is minor and can be reasonably remedied, we may offer repair or replacement.
Refunds or exchanges are not offered for change of mind or incorrect selection.
Intellectual Property
All artwork, images, text, and content on the Website remain the intellectual property of Nikki Malvar Studio. Purchasing an artwork does not transfer any copyright or intellectual property rights.
You may not reproduce, distribute, modify, or otherwise use any content or artwork without prior written permission from Nikki Malvar Studio.
Linking to the Website
You may link to the Website in a way that is fair and lawful and does not suggest endorsement or association where none exists. We reserve the right to request removal of any link at our discretion.
Liability and Indemnity
To the extent permitted by law, Nikki Malvar Studio is not liable for indirect or consequential loss arising from your use of the Website or purchase of products.
You agree to indemnify and hold harmless Nikki Malvar Studio from any claims arising from your breach of these Terms, misuse of products, or infringement of third-party rights.
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
Privacy
Personal information is collected and handled in accordance with our Privacy Policy and Australian privacy law. We do not sell personal information.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
Entire Agreement
These Terms constitute the entire agreement between you and Nikki Malvar Studio in relation to purchases made through the Website.
